INCUMBENT OPPOSED PRACTICAL SQUATTER REFORM


The incumbent commissioner admits squatters are trespassers but fought to protect government spending over property owners.


In his March 2025 official newsletter, the incumbent commissioner testified against House Bill 32 and stated:


“I agree that landlords should not have the burden, but this bill is not addressing the squatter issue, instead it will be a burden on Dallas County and its taxpayers.”


He pushed for more taxpayer-funded legal aid and rental assistance instead.

Texas Disciplinary Rules for Professional Conduct Exists for Exactly This Situation

A Dallas County commissioner whose law firm practices in county courts has a conflict because the Commissioners Court controls the budget and purse strings for those courts.


Key Points:

  • Before becoming Commissioner, Sommerman personally represented County Judge Clay Jenkins as his attorney in high-profile lawsuits.
  • Sommerman’s own law firm continues working cases in the very courts the Commissioners Court funds.
  • Clay Jenkins has ties to personal injury law firms.

CLEAR NEED FOR INDEPENDENT WATCHDOG


Before joining the court, the incumbent commissioner was County Judge Clay Jenkins’ personal attorney. Now they serve together while his firm, Jenkins’ firm ties, and Domingo Garcia’s firm all practice in the courts the court funds. 


This is the appearance of an insider club — not independent oversight. District 2 deserves a commissioner with zero divided loyalties.

Questions Presented:

Is it a conflict of interest for an Attorney (“Attorney”) who is an elected county commissioner of Dallas County to practice law in the justice, statutory county, and district courts in Dallas County? 


If Attorney has a conflict of interest, is it imputed to all members of his or her law firm? 


Conclusion:

Attorney who is a county commissioner would violate Rule 1.06(b)(2) by representing a private client in any justice, statutory county, or district courts in that county in the absence of effective consent by all affected or potentially affected clients as required by Rule 1.06(c). 


This conflict of interest also applies to all attorneys associated with the Attorney’s law firm.

The incumbent commissioner publicly took credit for making IANT (Islamic Association of North Texas) and Madinah Masjid permanent voting locations and claimed they helped Democrats win close races.

  • He later announced Madinah Masjid in Carrollton as another.
  • IANT has collaborated with CAIR-Texas.
  • In November 2025, Governor Greg Abbott, the Republican Party of Texas, and the Dallas County Republican Party officially designated CAIR as a foreign terrorist organization and transnational criminal organization.


THE INCUMBENT ADVANCES THE RED-GREEN ALLIANCE


The incumbent takes credit for setting up polling locations at mosques that helped put Democrats over the top. At the same time, he aligns himself with networks that Governor Abbott, the Republican Party of Texas, and the Dallas County Republican Party have officially designated as terrorist organizations. Polling shows that tens of thousands of Democrats in this district disapprove of far-left figures like Zohran Mamdani and Alexandria Ocasio-Cortez.  


The incumbent’s own official county January-February 2026 newsletter linked to “Fight Back! News” — a Marxist-Leninist outlet that promotes revolution — and he has participated in CECS events. Both are documented on his taxpayer-funded government website.  


His actions advance the very Marxist and Islamist networks that even many Democrats are now rejecting.


VIOLATION OF OATH OF OFFICE CONCERNS


Under the Texas Constitutional Oath, a County Commissioner swears to faithfully execute their duties and preserve, protect, and defend the Constitution and laws of Texas. Commissioners also sign an anti-bribery statement.


Using official authority to set up and celebrate polling locations in institutions tied to designated organizations — while claiming they help determine partisan winners — raises serious questions about neutrality and the appearance of impropriety.


ATTACKED PRECINCT VOTING WHILE WEAKENING ELECTION INTEGRITY


While the incumbent pushed election systems that weaken ballot secrecy and auditability, he joined the Commissioners Court in attacking Barry’s efforts to protect convenient, walkable precinct-based polling places across District 2. 


Barry led the fight to safeguard the constitutional right to a secret ballot for all voters — Democrats, Republicans, and independents alike.
